is it allowed to use the images that came with the theme to use on my site?

Images used in the slider provided to demonstrate the template. And they are not part of the template, so they should not be used with it.

after theme activation the Social Profiles on the left side don't scroll anymore with page scrolling.
How could this be fixed?
